The New York Daily News reports that a suit filed against American Apparel founder, Dov Charney, has been tossed out in New York as there was already an arbitration agreement in California. It seems as though this plaintiff was giving her suit a try in the courts of two states at the same time.

“A salacious suit accusing American Apparel’s hipster honcho of forcing sexual favors from a teen employee has been tossed out by a Brooklyn judge and sent to arbitration.
Irene Morales, 21, had claimed the clothing line’s CEO, Dov Charney, 43, held her captive in his Manhattan pad. In a lawsuit filed a year ago, she asked for $260 million in damages.
But her claims were undermined by a trove of explicit pictures and messages she sent her boss, which were made public during the contentious litigation.
In a decision this week, Supreme Court Justice Bernadette Bayne ruled that a California court already ordered that a similar suit filed by Morales be settled in arbitration and that the order is also binding in New York.”
